HFA Secures Key Wins

in National Click-To-Cancel Regulation

What Happened:

The FTC has released its final Click-to-Cancel Rule, and thanks to HFA’s advocacy, we secured six important victories that directly benefit fitness facilities:
  • Annual Reminder Requirement Removed: No need for annual reminders for gym memberships.
  • Retention Flexibility Preserved: You can still offer pauses, freezes, and tier adjustments when members look to cancel.
  • Secure Cancellation Processes: The rule includes critical safeguards against fraud and unauthorized cancellations.

Why It Matters:

This is a powerful example of the importance of having a unified voice in Washington, D.C. for our industry. Without HFA’s focused advocacy, fitness facilities could have faced more burdensome regulations. Our success underscores the value of a dedicated trade association that speaks for the entire fitness industry.

These wins were achieved through the collaborative efforts of NHFA, which developed a consensus position that reflects the needs of our members. This ensured the FTC understood the operational realities of fitness facilities, particularly small businesses, resulting in regulatory outcomes that protect both your business and the industry.

What's Next:

The final rule will take effect 180 days after being officially posted in the Federal Register. HFA will provide resources to help ensure you’re fully prepared:
